§ 1 General provisions

  1. Service SolveIt Systems operates under the rules set forth in these Regulations.
  2. The Regulations define the scope of services provided electronically by SolveIt Systems, the rules for the provision of these services, as well as the complaint procedure.
  3. The operator of the Website is SolveIt Systems.
  4. In matters not regulated in the Regulations, the provisions of the Act of July 18, 2002 on the provision of electronic services (i.e. Journal of Laws of 2024, item 1513, as amended), the provisions of the Civil Code Act of April 23, 1964 (i.e. Journal of Laws of 2024, item 1061, as amended) and other applicable legislation shall apply to the provision of services on the Site.

§ 2 Definitions

  1. Terms used in the regulations, regardless of the use of lowercase or uppercase letters, mean:
  2. Newsletter - a service provided by the Operator to the User, allowing the User to receive from the Operator to the provided e-mail address information regarding the activity of the Website, after the User has voluntarily provided his/her e-mail address.
  3. Operator - SolveIt Systems.
  4. Privacy Policy - a document made available on the Website at /privacy-policy under the Privacy Policy tab, defining the rules of processing personal data by the Operator.
  5. Regulations - this document, which defines the types and conditions for the provision of services by the Operator, the conditions for access, implementation and termination of such services.
  6. Service - website SolveIt Systems operating at solveit-systems.com.
  7. User - a natural person with full legal capacity, a legal person or an organizational unit without legal personality, who uses the services of the Website in accordance with the provisions of the Regulations.

§ 3 General principles of using the Service

  1. In order to use the services of the Website, the User must meet the technical requirements necessary for cooperation with the information and communication system used by the Operator, i.e.:
    1. Have access to the Internet,
    2. Have a properly configured email account,
    3. Have a properly configured and updated web browser,
    4. have cookies and JavaScript enabled.
  2. The Operator stipulates that the use of the Website's services may involve standard risks associated with the use of the Internet, and recommends that Users take appropriate steps to minimize them.

§ 4 Digital content

The services provided on the Website are provided through the creation and delivery of digital content to the User electronically, as defined in the Law of May 30, 2014 on Consumer Rights (i.e., Journal of Laws of 2023, item 2759, as amended).

§ 5 Principles of personal data processing

  1. The administrator of personal data is the Operator.
  2. Personal data is processed in accordance with the Privacy Policy made available on the Website at /privacy-policy under the Privacy Policy tab.

§ 6 Commercial information and newsletter

Sending the Newsletter to the User electronically to the provided e-mail address is possible after the User gives separate consent.

§ 7 Liability of the Operator

  1. The Operator shall not be liable for failure to perform or improper performance of obligations under the Terms and Conditions caused by circumstances beyond the Operator's control despite exercising due diligence.
  2. The operator is also not responsible for damages resulting from the suspension or discontinuation of Services by the operator.
  3. In addition, the Operator shall not be liable for damages, including lost profits, incurred as a result of the Users' use of the Website in a manner contrary to the Terms of Service or the law.
  4. Limitations of liability do not apply to a User who is a consumer within the meaning of Article 22¹ of the Civil Code Act of April 23, 1964 (i.e. Journal of Laws of 2024, item 1061, as amended).

§ 8 Intellectual property of the Operator

  1. Information resources and all other contents of the Site, such as texts, graphics, logos, buttons, images, are the intellectual property of the Service Provider or entities with which the Service Provider has entered into appropriate agreements and are protected by Polish and international laws on the protection of intellectual property, in particular by the provisions of the Act of February 4, 1994 on Copyright and Related Rights (i.e. Journal of Laws of 2022, item 2509).
  2. It is forbidden, without the Operator's consent, to copy, duplicate or any other use in whole or in fragments of information, data or other content available on or from the Website, except for cases of permitted use under generally applicable laws.

§ 9 Complaints and extrajudicial ways of handling complaints and redress

  1. The user has the right to file a complaint related to the functioning of the Website and the performance of services by the operator contrary to the terms and conditions specified in the Regulations.
  2. Complaints should be reported to the Operator only by electronic means via e-mail address: support@solveit-systems.com.
  3. Complaints shall be considered within 14 working days from the date of receipt of the complaint at the e-mail address indicated in paragraph 1.
  4. The response to the complaint is sent to the e-mail address provided by the User.
  5. The User, being a consumer within the meaning of Article 22¹ of the Civil Code Act of April 23, 1964 (i.e. Journal of Laws of 2024, item 1061, as amended), may use out-of-court ways to handle complaints and assert claims, for example:
    • shall be entitled to apply to the permanent amicable consumer court referred to in Article 37 of the Act of December 15, 2000 on Trade Inspection
    • shall be entitled to apply to the Provincial Inspector of Commercial Inspection
    • may obtain free assistance in resolving a dispute between him and the Operator
  6. Additional information on out-of-court ways to handle complaints and claims can be found on the website of the Office of Competition and Consumer Protection at www.uokik.gov.pl.

§ 10 Final provisions

  1. The content of the Terms and Conditions is subject to change. The User will be informed of any changes through information on the Operator's website. The effective date of the changes will not be less than 14 days from the date of their announcement.
  2. Settlement of any disputes arising between the Operator and a User who is not a consumer as defined in Article 22¹ of the Civil Code Act of April 23, 1964 (i.e. Journal of Laws of 2024, item 1061, as amended) shall be submitted to the court having jurisdiction over the seat of the Operator.
  3. If any of the provisions of the Terms and Conditions are declared invalid or unenforceable by a final judgment, the remaining provisions shall be valid and remain in effect.
